No, it's denying himself Due Process. He's not taking it away from anyone else, he was offered it, and refused. He was offered an investigation to clear his name, he refused it. He was given ample time (and water) to explain himself, he refused. If he can not even participate in his own confirmation, he should not be confirmed.
