The neighbors have two large dogs that they leave in the backyard all day, and sometimes all night. They have terrorized the neighborhood, and broken all of the fence-line around their yard.


They basically reduced my fence to a pile of toothpicks. I recently spent several hundred dollars to have that portion of my fence repaired.


Well, apparently, they really like my dog, because they broke through the back fence on my next-door neighbor’s house, and then broke through the fence between those 2 yards. And are back in my backyard.


I don’t wanna call animal control, because that would traumatize the dogs. But I am traumatized, and I’m basically stuck with them at my house until the neighbors come home from work, God knows when. And I thought I had taken care of this with replacing the fence. And now I’m gonna have to replace even more fence. And all that’s expensive, and these dogs’ owner is a complete derelict.

When the neighbors refused to come to the door, I finally gave up and called the police on a “non-emergency“ call. The responding officers know my neighbors. They went over and talked to them. He came over, retrieved his dog, apologized, and said he’d pay for his half of the fence repairs. Of course, he’s said all these things before. I sent him a copy of the fence repair receipt last night, and he was balking. So I’ll just sue them back into the Stone Age, if I have to. But please, control your pet. The guy works for animal control. I kid you not.

What RUINED your day today?

You read on the internet about how great VPN'S (virtual private networks) are-keeping you safe from google and all that, but my employer uses a VPN called citrix. On multiple occasions today, my computer froze or webpages just disappeared while I was working on them (I have to use 2 VPNs and 8 websites to work). I wasn't the only one having issues with citrix today-everyone was. Also, this is a frequent thing for citrix. So, if you consider a VPN, do your research first.

You do know in Texas, if a person doesn't pay on a lawsuit you can't attach on tangible property, only "non tangible property". So, if he owns a boat, but DOES NOT use it for work, then you can attach that. You can't attach his house, his car, any property inside, etc. unless you can prove that it is a non essential for day to day existence. I have degrees in Constitutional law and studied Texas law in college.

My first wife used to say she wanted to come back as one of our dogs.  I think she felt they had good lives.  For quite a while we had 6 dogs, and at one point as many cats.

One of those dogs was named Jed.  I took his name on-line in 2013 while he was still with us.  I had to put him down the following year at 13.  For such a big dog, he lived a good long life.  Before I buried my wife’s ashes, I spooned some of Jed’s ashes into hers knowing they both would have liked that.

Sorry for your loss of a loved one, as our pets are surely that.

I stand corrected. The reversal was on a procedural issue, not an evidentiary one*. So the Pennsylvania Supreme Court said he can’t be re-tried. However the prosecutor’s “agreement” with Cosby only dealt with the case involving Constand. And there are many others. Truth of the matter is, the man’s almost dead, and I doubt this will ever be initiated against him again.

In Lockhart v. Nelson, 488 U.S. 33 (1988), the SCOTUS held the double jeopardy clause allows retrial of a defendant when the appellate court determines that a defendant’s conviction was based in part on evidence which was erroneously admitted and that the remaining evidence was insufficient to support a conviction. A retrial is permitted to enable the defendant the opportunity to obtain fair adjudication of his guilt with legal evidence.

In Cosby, the Pennsylvania Supreme Court held that the prosecutor’s promise to not charge Cosby, in exchange for waiver of his 5th Amendment rights in a civil deposition, barred prosecution.  It wasn’t a ruling on the evidence, it was a ruling on him being tried in the first place.
