My guess would be that "not present" means dead. You can still hold political office in jail, others have before and will again.

I don't know what it means. If it's ambiguous, like most statutes are, then the Court will likely rule that her not being there counts as absent. If it physically requires her to be there then her being in jail will force the alternate judge into power. Either was the will of the Court is going to be imposted here.

It will be interesting to follow. The courts have historically had a hard time holding elected officials responsible when they refuse to follow a law.

Yes, but usually it's not them being in contempt of court. It's never a wise thing to essentially tell a Judge to go fuck themselves.

The problem is that MB got her feelings hurt in a debate she lost and wants to continue the fight here. That is fine, though I thought she said that she wasn't going to talk to me anymore. Oh well, I didn't expect too much consistency :P You and I were having a decent discussion, she wants to be an ass and add nothing. Par.

GB, sorry little man, but I suggest you look at the facts. I was having a good discussion with one of the few intelligent posters on the board. MB came and posted what we were already talking about. I told her that in a completely non-aggressive way:

"Ya MB, Piper posted that yesterday."

and then she went snarkmode and I responded.

This may be tough for you to understand, but just because someone is your friend or you agree with them politically is no reason to be blind to their actions.

It looks like they have tossed her ass in jail because folks were paying her fines for her.  Accordingly, the Judge felt that he had to punish her in some other way.

I respect that she feels that same sex marriage is wrong.  But freedom of religion does not mean imposing your religious beliefs on others. We have separation of church and state in this country for a reason.


If she felt she could not do the job because of this issue she should have resigned.

Even crazier was the fact that he offered to let her out if she would agree to not interfere with her deputies issuing licenses, and she refused. She hasn't resigned because of dat pay I'm sure. In Kentucky 80 k a year is a nice healthy salary. It probably doesn't hurt that her Mother was the clerk before her, or that her son also works there as well.
